Four months after that tragic evening outside of Select Lounge where Sean Gamble and Officer William Torbit, Jr. were shot dead, the decision is in – no charges will be filed in this case. The family of the slain officer demanded there be an independent investigation into the events of that evening.

It was one of those reports of an all too common fight at a city nightclub where Officer Torbit was reportedly in a scuffle with an individual seen fighting, Sean Gamble, in the club. It resulted in two people being killed, Sean Gamble and Officer Torbit. There were 40 shots fired, 20 of which hit the officer. Police arriving on the scene were not aware that the individual they were shooting at was a police officer. He was in plain clothes at the time.

“Now that the prosecution’s made its decision, I’m having our law department review our investigative file,” Rawlings-Blake said. “We will review it and do what we need to do to make it available for the public as soon as possible.”

The family of the victims have received enormous support from the City of Baltimore. Some supporters fear there is a cover up. Bernstein denies there is a cover up.

This case did not go before a grand jury. Bernstein made the decision. The mayor’s review will be out in a couple of weeks and is expected to focus on operational and possible training breakdowns within the department.

“I’m optimistic that we’ll be able to provide a full review,” said Baltimore Police Commissioner Frederick H. Bealefeld. Their investigation takes four months. Without making their findings public, the internal report is turned over to the prosecutor. At the same time, the mayor commissioned an independent review.

“My responsibility is to determine whether there were any violations of criminal law caused by any intentional conduct on the part of these officers that would have amounted to a violation of criminal law,” said Gregg Bernstein, City State’s Attorney. “In that regard, I do not believe there is sufficient evidence.”
